These Website Terms of Use govern your use of the gamma.earth public website (the "Website"), operated by Gamma Earth Sàrl, Chemin de la Scierie 10, 1162 St-Prex, Switzerland ("Gamma Earth", "we", "us"). They apply to the Website only. Access to and use of the Gamma Earth Platform at app.gamma.earth is governed by the Platform Terms of Service; the licensing of our software is governed by the License Agreement; commercial terms are set out in the Fee Policy; and our handling of personal data is described in the Privacy Policy.
1. Acceptance
By accessing or using the Website, you agree to these Website Terms of Use. If you do not agree, please do not use the Website.
2. Relationship to other documents
These Terms cover the public Website only. They do not grant any right to access the Platform or the software. Registering for an account, and any use of the API, SDK, or Google Colab interface, is governed by the Platform Terms of Service and the License Agreement.
3. No reliance on content
The Website presents technical information about our products, including resolution figures (for example, super-resolution from 10 m to 1 m across all ten spectral bands), example and comparison imagery, a counter of processed area, and performance comparisons with third-party providers. This content is provided for general information only. It is not a warranty or guarantee of performance for any particular area of interest, dataset, or use case. Actual results depend on the input data, acquisition conditions, and other factors. You should not rely on Website content as the sole basis for any decision.
4. Pricing is not an offer
Where the Website displays prices, credit rates, or regional pricing, those figures are indicative and provided for general information. They may change without notice, do not constitute a binding offer, and do not form a contract. Commercial terms that apply to a purchase are governed by the Fee Policy and any applicable Order Documents.
5. Intellectual property in Website content
All content on the Website — including text, diagrams, imagery, branding, and publications — is owned by or licensed to Gamma Earth and is protected by intellectual property laws. You may view and share links to the Website, but you may not reproduce, republish, or create derivative works from its content without our prior written consent, except where expressly permitted (for example, the citation of published articles in accordance with Section 9).
6. Copernicus and Sentinel-2 attribution
The Website displays and derives imagery from Copernicus Sentinel-2 data. Such imagery contains modified Copernicus Sentinel data. The Copernicus data is provided under the Copernicus data licence, which permits use subject to attribution.
7. Third-party trademarks
The Website may refer to third parties, including Airbus, Maxar, the European Space Agency (ESA), and Google, for the purpose of comparison or description. All such names, logos, and trademarks are the property of their respective owners. Their use on the Website does not imply any affiliation with or endorsement by those parties.
8. External links
The Website links to third-party websites and services, including social media, academic repositories, and demonstration environments. We do not control and are not responsible for the content, availability, or privacy practices of those third-party sites. Links are provided for convenience and do not constitute endorsement.
9. Publications
The Website may host articles, papers, and other editorial content with named authors and figures. Such content is provided for information. You may cite it with appropriate attribution to Gamma Earth and the named authors, but you may not reproduce it in full without our prior written consent.
10. Changes, governing law, and jurisdiction
We may amend these Website Terms of Use at any time by posting an updated version. Continued use of the Website after changes take effect constitutes acceptance of the revised terms.
These Website Terms of Use are governed by the substantive laws of Switzerland, excluding conflict of law rules. Any dispute arising out of or relating to them is subject to the exclusive jurisdiction of the courts of the city of Lausanne, Switzerland.
